Terms of use

1. Agreement

These Terms of use ("Terms") govern your access to and use of the Why We Viral web application, APIs, workers, and related services (collectively, the "Service") operated by Dominik Frey ("we", "us"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Why We Viral provides tools to organize TikTok profile research, collect publicly available profile and video metadata, store versioned records, run analytics, and export results. Features may change over time. We may add, modify, or discontinue functionality with reasonable notice when changes materially affect paid customers.

3. Accounts and organizations

• You must provide accurate registration information and keep credentials secure.
• Organization administrators control membership roles (viewer, analyst, admin) and configuration such as collect providers and TikTok sessions.
• You are responsible for activity under your account and for ensuring members comply with these Terms.

4. Acceptable use

You agree not to:

• Use the Service in violation of applicable law, export controls, or third-party terms (including TikTok's terms of service).
• Collect or process personal data you are not authorized to handle, or use the Service to harass, defame, or discriminate.
• Attempt to bypass access controls, probe systems without permission, or interfere with other customers' use.
• Resell, sublicense, or provide the Service as a hosted offering to third parties without a separate written agreement.
• Reverse engineer or copy the Service except where mandatory law permits.

5. TikTok and third-party platforms

TikTok content and metrics displayed in Why We Viral originate from public sources or APIs subject to TikTok's rules. We do not guarantee availability, accuracy, or completeness of third-party data. Platform changes may affect collecting, reports, or embeds without notice.

6. Customer data and license

You retain ownership of data you submit (project names, manual edits, collection fields, etc.). You grant us a limited license to host, process, and display that data solely to provide and improve the Service. Our Privacy policy describes how personal data is handled.

7. Fees and usage limits

The Service is currently provided free of charge. Each organization is subject to usage limits (for example projects, tracked profiles, collections, team members, collect jobs, and AI analyses), shown in the organization's Plan & usage settings. We may change these limits or introduce paid features in the future and will announce such changes in advance.

8. Intellectual property

The Service, including software, design, and documentation, is owned by Dominik Frey and protected by copyright and other laws. These Terms do not transfer any intellectual property rights to you except the limited right to use the Service as permitted here and in your license agreement.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OPERATION, ERROR-FREE RESULTS, OR THAT ANALYTICS OUTPUTS WILL MEET YOUR BUSINESS REQUIREMENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. Upon termination, your right to use the Service ends. We may retain backups for a limited period as described in the Privacy policy.

12. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance.

13. Governing law and contact

These Terms are governed by the laws applicable in Hungary, without regard to conflict-of-law rules, unless mandatory consumer protection law in your country requires otherwise. Questions: Contact.
